Example: You write a great book (like Harry Potter) with many succes and someone will make a game for it without paying you money. Of course you will complain you.

He didn't said, that he is going to/will sell it. Maybe it is a freeware.
But you can hack pokémon diamond, perl, emerald, ruby, sapphire. And this games arn 't so old. 1, 2 or three years old. And they are allowed to hack them.
My tipp is the following:

You shouldn't wait so long, because you want to make your own Pokémon Game as quick as possible of course. Write an E-Mail to Nintendo and then wait until they give you an answer. I hope you would get a green light, because I like pokémon soooooooo..... much. I love it! I'm playing this 9 years. Tomorrow, it is going to be 10 years( I am going to celebrate my jubilee ).

And an important tipp:

• If you want to make a game like pokémon, you should ask for the license, because of the copyright I think. If they give you a green light, you can open a thread like this, but if you don' t get a green light, called red light, you can't make a thread. The fact of this tipp is, that you must ask for something was already made to make a another version of the game and to have a green light before you create a thread, because if you have a red light, then would this thread trashed or closed for nothing at all. First ask - then working on it.

Basically you can release it as a Non-Profit program/Game.

He said it costs money.
Yes you can hack pokemon roms, that does not alter the actual game. However if you rewrite the bytecode, then release the game, then it is illegal, also acquiring a ROM of the game with out prior ownership of the game is also illegal.

Pokemon is intellectual property licensed to Nintendo, as far as they are concerned they will bring up lawsuits against anyone who decide to violate their intellectual property. Remember Pokemon's not licensed under GNU or any other liberal licenses.

Theres a subtle difference between commercial and personal releases...

well i have no huge experience in programming languages but i will do alot of level designing and mapping (got about 4 years experience in mapping for different games and such).
this wont be a freeware but i want to know if i can get people in before asking for permissions.
wont start working before we ask nintendo.
