Well, you in no way implied copyright upon the image, so therefore it is entirely legal. According to international copyright laws, if you do not asserts copyright via a copyright notice ( either on your avatar or in your signature ) it is considered public domain until someone assert copyright. This can either be you or him. Another thing, copyright is not paid for! It is entirely free! One simply asserts copyright with "Copyright © UR_NAME YEAR_OF_CREATION", which would stand as a copyright notice.

The Alt code for © is alt+0169, btw.

And another thing, it has to be clearly visible ( not huge, just easily seen ).

Well if you dnt want to assert copyright he can use your avatar as much as he likes. Your choice.

EDIT: infact anyone can use it as much as they like, lol.

EDIT2: Your copyright notice is incorrect, say if your name was John Smith, you would write: Refresh Avatar Copyright © John Smith 2011

Well, replace 2011 for which ever yar you created it. You may also want to contact ModCreator and tell him to remove your avatar.

Another way to attain copyright is to create a company or have one already, then you can assure that it is your graphic image if you put the company copyright on it that will imply that your company now owns it.

If the graphic of that company has been used inappropriately(as in someone is copying it and using it somewhere else) then your company can immediately sue the person who used it and that person will receive a penalty, in the form of fines usually. Because the company that created the graphic will be the legal owner of that graphic and not anybody else.

You can also add Creative Commons license on that graphic, if that helps.

He doesn't need copyright nor other shit.
The guy clearly broke a rule.
When you upload/change your avatar, there's a rule there saying:
× No images which are already used by other users (leads to confusion).
Yeah, you don't need copyright and nobody is free to use other's avatar in this forum with this rule.
So enough bullcrap.
